The NY State Court of Appeals, the highest court in the state, ruled yesterday that Nassau County can not shift the cost and responsibility for property tax refunds on to school districts (or towns and villages). The County must now find $350-$400 million to pay pending tax refunds; the County does not have that money available. Last year, an all-time record 150,000 tax protests were filed against the County. If YOU did not file a property tax protest, then your property tax will be higher than your neighbors taxes who did file protests. To keep abreast of your neighbors, you should file a property tax protest every year, until the broken assessment system is fixed. County Executive Mangano is today proposing to shift the property tax assessment function from the County to the Townships. Of course, the Townships (Hempstead in the case of Wantagh UFSD) have no experience or expertise in assessing property. The bigger problem with that idea is that the former North Shore/South Shore assessment imbalance, which had existed since 1939 and was finally corrected by the Court of Appeals several years ago, will return, with no way to correct it in the future. That would mean the south shore would pay a disproportionately larger percentage of County expenses than the north shore...through their Town Taxes (if Mangano's latest proposal were enacted).
