Nassau County has been barred from passing the responsibility and cost of property tax certiorari refunds to school districts and towns. The decision was based on state constitutional grounds, and requires Nassau to live up to its guarantee to be financially responsible for assessment errors created by the County. If the verdict had been different, then school districts would have to pay property tax certiorari refunds. The school district has zero control over property tax assessments, and no ability to cure incorrect assessments. This is very good news indeed.
